1. Overview
These Terms of Service (“Terms”) govern your access to and use of the services provided by Global Archives (“Company,” “we,” “our,” or “us”), including:
- Records assessment and consulting services
- Physical records storage and management
- Digitization and metadata services
- Retention schedule and compliance advisory
- Access to the GlobalArchivesVault™ digital records management platform
- Preservation and lifecycle governance services
By engaging our services or accessing our website, you agree to these Terms.
2. Scope of Services
Global Archives provides records and information management services designed to support archival, preservation, compliance, and accessibility needs.Nothing on the website constitutes a binding service agreement without executed documentation.
3. Compliance Disclaimer
While we align our services with applicable laws (including FERPA, HIPAA, IRS regulations, and Montana State retention schedules), final legal responsibility for compliance rests with the client organization. Our role is advisory and operational—not legal counsel.
4. Global Archives Vault – Platform Use
Where applicable:
- Vault access is provided under subscription terms.
- Access is role-based and subject to administrative controls.
- Activity logs are maintained for audit and defensibility.
- Clients are responsible for user account management.
- Unauthorized access or misuse may result in suspension of service.
5. Data Security & Stewardship
We implement reasonable administrative, technical, and physical safeguards to protect client records, including:
- Controlled facility access
- Secure digitization protocols
- Redundant digital storage (where applicable)
- Audit logging for digital records
However, no system can guarantee absolute security.
6. Intellectual Property
Global Archives retains ownership of:
- Proprietary workflows
- Software systems (including GlobalArchivesVault™)
- Documentation frameworks
- Training materials
Clients retain ownership of their records and content.
7. Limitation of Liability
To the maximum extent permitted by law:
- Our liability is limited to the amount paid under the applicable agreement.
- We are not liable for indirect, incidental, or consequential damages.
- We are not responsible for losses caused by inaccurate client-provided information.
8. Governing Law
These Terms are governed by the laws of the State of Montana.
